Your CCPA/CPRA Rights
As a California resident, you have the following rights:
Right to Know
You have the right to request that we disclose:
- The categories of personal information we collected about you
- The categories of sources from which we collected it
- Our business purpose for collecting it
- The categories of third parties with whom we shared it
- The specific pieces of personal information we collected about you
Right to Delete
You have the right to request deletion of personal information we collected from you, subject to certain exceptions.
Right to Correct
You have the right to request correction of inaccurate personal information we maintain about you.
Right to Opt-Out of Sale/Sharing
You have the right to opt out of the "sale" or "sharing" of your personal information.
We do not sell your personal information. We do not share your personal information for cross-context behavioral advertising.
Right to Limit Use of Sensitive Personal Information
You have the right to limit how we use your sensitive personal information. Being uses sensitive personal information (mental health data) only for providing our Services—not for profiling, advertising, or any secondary purpose.
Right to Non-Discrimination
We will not discriminate against you for exercising your privacy rights. You will not receive different pricing or quality of service for exercising these rights.
How to Exercise Your Rights
In-App
Go to Settings > Privacy to:
- View your data
- Export your data
- Delete your data
By Email
Send your request to privacy@being.fyi
Include:
- Which right you want to exercise
- Approximate first-use date, device type, and time zone (to help us locate the relevant data — v1 operates anonymously, so we cannot match by email or account)
- Any other details that help us understand your request
Verification
In v1, Being operates anonymously and does not maintain account records that could be matched to a verification request. To protect your privacy while still fulfilling requests:
- In-app fulfillment is preferred. Most rights (access, deletion, export, opt-out) can be exercised directly from Settings → Privacy & Data without verification, because your device is the authoritative copy of your data.
- For email requests to privacy@being.fyi, we may ask for usage-pattern information (approximate first-use date, device type, time zone) to help us locate any relevant settings-backup data tied to your device.
- Email requests will receive a response within 45 days as required by CCPA §1798.130(a)(2), even where in-app fulfillment is the appropriate path.
Authorized Agents
You may designate an authorized agent to make requests on your behalf. We require:
- Written authorization from you
- Verification of the agent's identity
- For consumer verification: usage-pattern information about the consumer's use of the app (in lieu of account-based verification, which is unavailable in v1)
Response Timing
We will respond to verifiable requests within 45 days. If we need more time (up to 90 days total), we will notify you.
Sensitive Personal Information
Being collects sensitive personal information as defined under CPRA, specifically:
- Mental health information: PHQ-9 scores, GAD-7 scores, mood check-ins, journal entries
How we use it:
- Solely to provide the wellness features you request
- To detect crisis indicators and offer safety resources
- NOT for profiling, advertising, or secondary purposes
Your control:
- All sensitive personal information is stored locally on your device only — Being does not transmit PHQ-9 / GAD-7 responses, mood check-ins, or journal entries to any server
- The optional settings backup (see Privacy Policy §4.2) is scoped to non-sensitive app preferences only and does not include any sensitive personal information
- You can delete this data at any time via in-app Settings → Privacy & Data
Data Retention
We retain your personal information only as long as necessary for the purposes described in our Privacy Policy:
| Data Type | Retention |
|---|---|
| Wellness data (local, on your device) | Until you delete it via in-app settings, or uninstall the app |
| Settings backup (cloud, optional) | Until you disable backup or request deletion via in-app Privacy & Data settings |
| Usage analytics (opt-in only) | 12 months, anonymized after 30 days |
Financial Incentives
We do not offer financial incentives for the collection, sale, or deletion of personal information.
